Introduction

DillonMarcus provides the Spot-It™ services through the Spot-It™ mobile app (the “App”) and the Spot-It™ website (the “Website”) at https://www.whynotspot-it.com/. The Spot-It App is a tool to help you manage mental health and stress. DillonMarcus, the owner of the App and Website, respects your privacy and is committed to protecting it as described in this privacy policy. For the purposes of this privacy policy, DillonMarcus, as the licensee of the Spot-It™ method and owner and developer of the App and Website, is referred to as “Spot-It™, “we,” or “us”.

This privacy policy describes the types of information Spot-It collects from you or that you may provide when you use the App or visit the Website and our practices for collecting, using, maintaining, protecting, and disclosing that information.

This privacy policy applies to personal information Spot-It collects:

  • On the Website.
  • In the App
  • In email, text, and other electronic messages between you and the Website or App.

This Privacy Policy does not apply to information collected:

  • Offline by Spot-It; or
  • Through any other means, including on any other website operated by DillonMarcus or any third party, including through any application that may link to or be accessible from or on the App or Website.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is not to use the App or the Website. By accessing or using the App or the Website, you agree to this privacy policy. This privacy policy may change from time to time (see, Changes to Our Privacy Policy, below). Your continued use of the App or Website after we make changes is deemed to be acceptance of those changes, so please check the privacy policy periodically for updates.

Children Under the Age of 16

The App and Website are not intended for children under 16 years of age. We do not knowingly collect personal information from children under 16. If you are under 16, do not use or provide any information on the App or Website or on or through any of the App or Website features. If we learn we have collected or received personal information from a child under 16 without verification of parental consent, we will delete that information. Categories of Personal Information We Collect

We collect several types of personal information from and about users of the App and Website. For the purposes of this privacy policy, “personal information” means any information that relates to an identified or identifiable individual. Contact Information, identifiers, and Account Information

This is information by which you may be personally identified, such as first and last name, postal address, e-mail address, telephone number, or any other identifier by which you may be contacted online or offline. Account Information is collected when you sign-up to use the App.

Usage and device information

That information does not directly identify you but is linked to you or your device, such as device IDs and IP addresses. This also includes information about your internet connection, the equipment you use to access the App or Website, and usage details.

Content Information

Information that you enter into fields in the App or Website.

Correspondence with Us

We collect information about and copies of your correspondence when you contact us by email, mail or telephone.

User Content

Information you submit over the App related to stressful situations and information you submit in text fields or the diary feature of the App.

 

We collect this information:

  • Directly from you when you provide it to us.
  • Automatically as you navigate through the Website or use the App. Information collected automatically may include usage details, IP addresses, and information collected through cookies and other tracking technologies.
  • From third parties, for example, if you receive access to the App through your employer, health plan another Spot-It business partner, we collect your name and email address and other information about you that the employer, health plan, or other business partner provides to us so that we may make the App available to you.

Aggregated, Anonymous, and De-identified Information

We may create aggregated, anonymous, or de-identified data from personal information by removing data elements that make the data personally identifiable to you or linkable to you. Once information is aggregated, anonymized, or de-identified the information is no longer personal information and is not subject to this Privacy Policy. When we create aggregated, anonymous or de-identified data, we will not attempt to re-identify individuals from that aggregated, anonymous, or de-identified data.

Information We Collect Through Automatic Data Collection Technologies

As you navigate through and interact with our App or Website, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to the App or our Website, including traffic data, logs, approximate location (through your IP address), and other communication data and the resources that you access and use on the Website.
  • Information about your computer or device and internet connection, including your IP address, operating system, and browser type.

The information we collect automatically includes personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our App and Website and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our App and Website according to your individual interests.
  • Recognize you when you return to our App and Website.

The technologies we use for this automatic data collection may include browser cookies.  Browser cookies are small files placed on the hard drive of your device. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.

Third-Party Use of Cookies

Some content or applications on the Website and App are served by third parties, including application providers like Kajabi, which hosts the Spot-It™ Social. These third parties may use cookies to collect information about you when you use our website. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content. We do not control whether or how Kajabi or other third parties use tracking technologies. If you have any questions, you should refer to Kajabi’s privacy policy.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To provide the Website and App and their contents and features to you.
  • To provide you with information, products, or services that you request from us and to notify us of updates or changes to the App or Website.
  • To fulfill any other purpose for which you provide it.
  • To provide you with notices about your account, including expiration and renewal notices, and to provide customer service.
  • To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
  • To allow you to participate in interactive features on our App or Website.
  • To protect ourselves, you, and others, to prevent fraud and other unlawful or unauthorized activity, and to create and maintain a secure and reliable App and Website.
  • To improve our products and services, the Website and the App.
  • To engage in analytics in how the Website and App are used.
  • To comply with our legal obligations, respond to subpoenas, court orders, or legal process, and establish or exercise our legal rights or defense against legal claims.

How We Disclose and Share Your Personal Information

Nevada provides its residents with a limited right to opt out of certain personal information sales. If you wish to opt-out of these sales, please email us at [email protected]. However, note that we do not sell your personal information and we do not share your personal information with third parties for their own direct marketing activities.

We may disclose personal information that we collect, or you provide as described in this privacy policy:

  • To our subsidiaries and affiliates.
  • To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them.
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of DillonMarcus's assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by DillonMarcus about our App or Website users is among the assets transferred.

  • For any other purpose disclosed by us when you provide the information.
  • With your consent.

We may also disclose your personal information:

  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
  • To enforce or apply our terms of use and other agreements, including for billing and collection purposes.
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of DillonMarcus, our customers, or others.

Do Not Track

We do not currently respond to “do not track” signals.

Choices About How We Use and Disclose Your Information

We strive to provide you with choices regarding the personal information you provide to us. You are able to control how we use your personal information in the following ways:

  • Browser Cookies. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Website may then be inaccessible or not function properly.
  • Promotional Offers from the Company. If you do not wish to have your email address used by the Company to promote our own or third parties' products or services, you can opt out by sending us an email stating your request to [email protected].
  • Deleting Your Personal Information. We cannot delete your personal information without deleting your account. If you wish to delete your account and your personal information, please contact us at [email protected].

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users' personal information, we will notify you by email to the primary email address specified in your account. The date the privacy policy was last revised is identified at the top of this page. You are responsible for ensuring we have an up-to-date active and deliverable email address for you, and for periodically visiting our App and Website and this privacy policy to check for any changes.

Users Outside of the United States

Spot-It is located in the United States. When you use the App or Website, your personal information will be processed in the United States, or in countries where Spot-It’s service providers may be located. The privacy laws of these other countries may be less protective of your personal information than the laws in your country. By using the App or Website, you agree to the transfer, storage, and processing of your personal information in a country other than your country of residence including, but not necessarily limited to, the United States.
